1. Copyright notice
© 2026 [Company legal name] (ABN [ABN]). All rights reserved.
“Funky Fables”, the Funky Fables logo and the stories, characters and artwork in the Service are the property of [Company legal name] and its licensors. Nothing on this page, in our Terms of Use or in the Service gives you ownership of, or a licence to use, any of it beyond the limited personal use described below. Any right not expressly given to you is reserved.
2. What is protected
This page applies to all content made available through the website at funkyfables.com and the iOS and Android apps, whether you view, hear or download it (together, the “Content”). The Content includes:
- Written material: story text, titles, summaries, descriptions, captions, questions, page text, and help and marketing copy;
- Images: illustrations, cover art, page art, backdrops, characters, avatars, icons, animations, thumbnails and every other visual, including each individual image taken from a book;
- Audio: narration and voice performances, music, songs, sound effects, ambient sound, mixes and the sound recordings themselves, including any individual track, clip or segment;
- Compilations and designs: the way stories are selected, arranged and presented, page layouts, reading and listening experiences, interface designs, data files and book packages;
- Software: the website and apps, and the code, tools and systems behind them.
Each of these can be protected separately, for example as a literary work, an artistic work, a musical work, a sound recording or a computer program, under the Copyright Act 1968 (Cth) and under international copyright treaties that give the same protection in most other countries. Protection applies automatically, whether or not a copyright symbol is shown.
3. Who owns it
- [Company legal name] owns, or holds a licence from the rights holder to use, all of the Content. We commission and license authors, illustrators, narrators, musicians and sound designers under agreements that give us the rights we need to publish the Content in the Service.
- Some Content is created with the help of AI tools under human direction and review, as described in our AI Policy. We own that Content, and hold every right in it that the law allows us to hold. These terms apply to it in exactly the same way as to any other Content.
- Where an author, illustrator, narrator or other contributor keeps their moral rights, such as the right to be credited and the right not to have their work treated in a derogatory way, we respect those rights. Do not remove or change credits, copyright notices or watermarks.
- Using the Service, signing up, paying for a plan or downloading a story for offline listening never transfers ownership of any Content to you.
4. What you may do
While your account is active and in good standing, you and your family group may use the Content through the Service for private, non-commercial enjoyment. That means you may:
- read, view and listen to stories in the website and the apps;
- download stories inside the apps for offline playback, as set out in section 5;
- take an ordinary screenshot of your own device or share a link to the Funky Fables website so someone else can find us, as long as you do not share the Content itself, or use the screenshot for anything other than personal reference;
- use the law’s exceptions to copyright, such as fair dealing for criticism, review or news reporting, with proper attribution to Funky Fables and without using more of the Content than is reasonably needed.
5. Downloads and offline playback
Downloads exist for one reason: so that a child can listen where there is no internet connection, such as in the car or on a flight.
- Downloads are only authorised through the official Funky Fables app. The app is the only approved way to download Content. Any other way of obtaining a copy of the Content, from the website, the app’s storage, a network connection or anywhere else, is not authorised.
- Downloads are authorised for offline playback only. A downloaded story may be played inside the Funky Fables app, on a device where you are signed in to your account, and for no other purpose.
- You do not own a downloaded story. The download is a temporary, protected copy that stays under our control. We may switch off, expire or remove downloads at any time, including when an account or plan ends, when a story is withdrawn, or when the app has not connected to the internet for a long period.
- Downloaded files must stay in the app. They are stored in a protected form and are not authorised to be copied, exported, extracted, converted, backed up outside the app, transferred to another device or account, or played in any other app or player.
- Downloading does not give you any right to use the Content outside the official app, including on social media, in videos, at events, in classrooms or care settings beyond your own family, in other apps or in any product or service.
Our Terms of Use set out the practical limits on devices and downloads.
6. What you may not do
Without our express written permission, you must not, and must not help or allow anyone else to, do any of the following with the Content, in whole or in part, including any single page, image, sentence, sound or clip:
- Copy or capture it. Reproduce, download (other than through the app’s offline feature as described above), record, screen-record, rip, capture audio from, scrape, crawl or save it by any other means.
- Share or distribute it. Publish, upload, post, stream, broadcast, email, message, sell, rent, lend, license, sublicense or otherwise make it available to anyone outside your own family group, including on websites, social media, video or file-sharing platforms, podcasts and other apps.
- Use it commercially or publicly. Use it in any product, service, advertisement, publication, merchandise, course, performance or public display, whether or not you are paid.
- Change it. Adapt, translate, edit, remix, sample, re-voice, colourise, animate, crop out credits or watermarks, or make any derivative work from it, including fan art or audio built from our recordings.
- Bypass our protections. Remove, disable or work around encryption, digital rights management, watermarking, access controls or any other technical protection measure, or reverse engineer, decompile or extract files from the apps. This is unlawful under the Copyright Act 1968 (Cth) in addition to breaching our terms.
- Misuse the apps and files. Move downloaded files out of the app, play them elsewhere, or use another person’s account or a shared account outside a single family group to obtain Content.
- Mislead. Claim any Content as your own, remove or change copyright notices, or suggest that Funky Fables endorses you or your product.
These limits apply to every format, now known or developed in future, and to Content shared, edited or recreated by someone else without our permission.
7. Asking for written permission
If you would like to use any Content in a way that is not described in section 4, for example in a school or library programme, a publication, a video or a partnership, please ask first. Email support@funkyfables.com with the subject line “Permission request” and tell us:
- who you are and who you are acting for;
- exactly which Content you want to use (story title and page, image or recording);
- how, where and for how long you want to use it, and who will see it; and
- whether you will be paid or will charge anyone.
Permission is effective only if it is in writing and signed, or sent by email, by someone authorised to act for [Company legal name]. A conversation, a social media message, our silence, or an earlier permission for something else is not permission. We may say no, set conditions, or charge a licence fee. Any permission we give is limited to the use described in it and does not transfer any ownership.
8. AI, data mining and machine learning
You must not use the Content, or any data collected from the Service, to train, fine-tune, test, evaluate, prompt, ground or improve any artificial intelligence or machine learning model or system. This includes copying images, text or audio into an AI tool, cloning or imitating narrators’ voices, and generating artwork or stories that imitate our characters or style from our Content.
We do not permit automated text and data mining of the Content by any person or system. Automated tools, crawlers and bots must not access the Service to collect Content. To the extent that any law allows an exception for text and data mining, we expressly reserve our rights and opt out of that exception.
9. Names, characters and logos
“Funky Fables”, the Funky Fables logo, the story and character names, and the look and feel of the Service are our brands and, where registered, our trade marks. Do not use them, or anything confusingly similar, as a name, logo, domain name, social media handle, app name or product name, or in a way that suggests we are connected to or endorse you, without our written permission.
10. Third-party material
Some music, sound effects, fonts, software and other material in the Service is licensed to us by others. It remains the property of its owners, and our licences allow us to include it in the Service only. Nothing here gives you any rights in third-party material, and you must comply with any additional conditions we show for it.
11. Enforcement
We take the protection of our Content seriously. If we find or suspect misuse, we may, without notice:
- suspend or end the accounts, downloads and access involved, as set out in our Terms;
- ask websites, app stores, social media platforms, hosting providers and other services to remove copied Content, and ask search engines to remove links to it;
- use technical measures to detect and block copying, including watermarks and monitoring of unusual downloading patterns, in line with our Privacy Policy; and
- take legal action to stop the misuse and claim remedies, which can include injunctions, damages or an account of profits, and legal costs. Serious or commercial copyright infringement can also be a criminal offence.
12. Reporting misuse or infringement
If you see our Content being used without permission, or you believe something in the Service infringes your own copyright, email support@funkyfables.com with the subject line “Copyright notice”. Please include a link or description showing where it appears. For claims about material in the Service, the details we ask for are set out in section 9 of our Terms of Use.
13. Changes to this page
We may update this page when our Content, features or the law change. The date at the top shows when it was last updated. This page works together with our Terms of Use. If anything here conflicts with the Terms about the protection of the Content, the stricter protection for the Content applies.
